電子商務服務條款及細則

E-commerce Service Terms and Conditions

本(商城)電子商務服務為顧客和賣方提供買賣商品的平台和機會。「賣方」指第三方商戶。特定產品上架說明中可載明該產品是否由本電子商務服務上架出售。由賣方出售予您的產品將受個別買方合約的規限：就第三方商戶售出的商品而言，該合約為僅由第三方商戶與您之間直接訂立的協議。

This (mall) e-commerce service provides customers and sellers with a platform and opportunity to buy and sell goods. "Seller" means the Third Party Merchant. The listing description of a specific product may indicate whether the product is listed for sale by this e-commerce service. Products sold by the Seller to you will be subject to an individual buyer contract: for products sold by a third-party merchant, this contract is an agreement entered into solely between the third-party merchant and you.

顧客和賣方之間的合約承擔責任。第三方商戶售出的商品由賣方合約承擔全部責任，包括商品上架、購買保證及其他購買相關詳情。

The contract between the customer and the seller assumes liability. Products sold by third-party merchants are fully responsible for the seller's contract, including product listing, purchase guarantee and other purchase-related details.

倘若顧客擬使用本電子商務服務購物服務、或僅希望瀏覽本電子商務服務，在使用本電子商務服務前均請細心閲讀本使用條款及細則。顧客使用本電子商務服務或本電子商務服務的任何部分，即代表顧客已閱讀本使用條款及細則並同意接受其約束。

If a customer intends to use this e-commerce service for shopping or simply browses this e-commerce service, please read these terms and conditions of use carefully before using this e-commerce service. The customer's use of this e-commerce service or any part of this e-commerce service indicates that the customer has read these terms and conditions of use and agrees to be bound by them.

一般規定 / General Provisions

1. 在本使用條款及細則內，下列字詞具有如下定義:

2. 「優惠券」指賣方發行並可於本電子商務服務有效使用的任何優惠券，包括但不限於「電子優惠券」、「送貨優惠券」及「第三方優惠券」。

   "Coupon" refers to any coupon issued by the seller and valid for use in this e-commerce service, including but not limited to "electronic coupons", "delivery coupons" and "third-party coupons".

3. 「顧客」指顧客、及(如上下文適用時)指使用顧客的登入賬戶使用本電子商務服務的所有其他人士。

"Customer" means the Customer and, where the context is applicable, all other persons who use the Customer's login account to use the e-commerce services.

4. 「送貨優惠券」指賣方發行並可於本電子商務服務有效使用及可根據本使用條款及細則兌換送貨費折扣的優惠券。

   "Delivery Coupon" means a coupon issued by the Seller and valid for use in this e-commerce service and redeemable for a discount on delivery fees in accordance with these Terms and Conditions of Use.

5. 「電子優惠券」指賣方發行並可於本電子商務服務有效使用及可根據本使用條款及細則兌換折扣的優惠券。

   "Electronic Coupon" means a coupon issued by the Seller and valid for use in this e-commerce service and redeemable for discounts in accordance with these Terms and Conditions of Use.

6. 「登入賬戶」指在顧客的憑據下，顧客進入本電子商務服務的登入識別及密碼。

   "Login Account" refers to the customer's login identification and password to access this e-commerce service under the customer's credentials.

7. 「訂單」指顧客透過本電子商務服務提交的購買商品的要約。

   "Order" means an offer to purchase goods submitted by a customer through this e-commerce service.

8. 「價格」指顧客須就商品支付的價格。

   “Price” means the price the Customer has to pay for the Goods.

9. 「私隱政策」指刊載於此電子商務服務上，就處理從本電子商務服務收集所得的個人資料所採納的適用私隱政策。

   "Privacy Policy" means the applicable privacy policy published on this e-commerce service and adopted for the processing of personal data collected from this e-commerce service.

10. 「商品」指賣方在本電子商務服務提供銷售的任何及所有商品。

   "Items" means any and all items offered for sale by Seller on this e-commerce service.

11. 「賣方」指在本電子商務服務銷售商品的任何一方。

  "Seller" means any party selling goods on this e-commerce service.

12. 「第三方優惠券」指透過本電子商務服務發行的，可與第三方指定的商品兌換的優惠券。

   "Third-party coupons" refer to coupons issued through this e-commerce service that can be exchanged for products designated by third parties.

13. 「交易」指賣方和顧客分別通過本電子商務服務與訂單相關的商品買賣。

   "Transaction" means the purchase and sale of goods related to an order through this e-commerce service, respectively, by the Seller and the Customer.

14. 所有由賣方透過本電子商務服務銷售的商品均受本使用條款及細則的限制。顧客在本電子商務服務 提交訂單進行處理，即代表顧客確認已閲讀、明白並同意在顧客提交訂單時具有效力的使用條款及細則。

   All goods sold by Sellers through this e-commerce service are subject to these Terms and Conditions of Use. By submitting an order for processing on this e-commerce service, the customer confirms that he has read, understood and agreed to the terms and conditions of use that were in effect when the customer submitted the order.

15. 顧客同意：(i) 提供完整和最新的資料，以辦理本電子商務服務的登記手續；並(ii) 其只有權在任何時間持有本電子商務服務的一項登記。就有關以信用卡付款的登記而言，顧客須提供準確及完整的信用卡資料，並聲明及保證任何已於電子商務服務上登記的信用卡已獲授權並為合法。使用本電子商務服務時，顧客亦必須遵循以下條件：

   Customer agrees to: (i) provide complete and up-to-date information to register for this e-commerce service; and (ii) it is only entitled to hold one registration for this e-commerce service at any time. For registrations related to payment by credit card, customers must provide accurate and complete credit card information and represent and warrant that any credit card registered on the e-commerce service is authorized and legitimate. When using this e-commerce service, customers must also comply with the following conditions:

(a) 每位顧客只可在每項服務登記中註冊一個手機號碼及一部裝置；我們明確禁止同一顧客使用多個手機號碼及/或裝置；及

   Each customer can only register one mobile phone number and one device per service registration; we expressly prohibit the use of multiple mobile phone numbers and/or devices by the same customer; and

(b) 任何顧客如意圖重複或多次使用每位顧客可享有的一次性優惠券或其他利益，均視為非法使用該優惠券或利益，並會導致相關優惠券或利益失效，及/或終止該顧客的服務登記。

   Any customer who intends to use a one-time coupon or other benefit that each customer is entitled to repeatedly or multiple times will be deemed to be using the coupon or benefit illegally, and will result in the invalidation of the relevant coupon or benefit, and/or the termination of the customer Service registration.

(c) 賣方保留向顧客收回任何不合法使用的優惠券或其他利益的價值之權利。

   The Seller reserves the right to recover from the Customer the value of any coupons or other benefits used unlawfully. 

(d) 我們擁有絕對酌情權，可基於任何理由拒絕任何人士登記成爲顧客，並可終止任何顧客的登記。

   We have the right in our absolute discretion to refuse registration as a customer to any person for any reason and to terminate the registration of any customer. 

(e) 顧客同意就每一項使用其登入賬戶所進行的訂購付款。顧客須負責更新其登記資料，包括透過本電子商務服務記錄的信用卡資料。其記錄如有任何變更或其信用卡如發生任何損失、盜竊或未經授權使用，顧客須自行負責向其銀行作出通知。

   Customer agrees to pay for each order made using its login account. Customers are responsible for updating their registration information, including credit card information recorded through this e-commerce service. Customers are solely responsible for notifying their bank of any changes to their records or of any loss, theft or unauthorized use of their credit cards. 

(f) 所有訂單須經賣方全權酌情接納方為有效，賣方接納的每項訂單（被接納的訂單被稱為「買方合約」）構成一份獨立的合約。您確認，除非您收到賣方表示接納您的訂單的通知，否則賣方不會成為賣方與您之間作出與產品出售或其他交易有關的任何具有法律約束力協議或承諾的訂約方，因而賣方毋須就由此招致的任何損失承擔責任。賣方保留全權酌情拒絕受理或接納來自平台或透過平台收到的任何訂單的權利。

   All orders are subject to acceptance by the Seller in its sole discretion to be valid. Each order accepted by the Seller (an accepted order is referred to as the "Buyer Contract") constitutes a separate contract. You acknowledge that unless you receive notification from the Seller of its acceptance of your order, the Seller will not become a party to any legally binding agreement or commitment between the Seller and you related to the sale of products or other transactions, and therefore the Seller shall not be held liable for any losses incurred thereby. The Seller reserves the right at its sole discretion to refuse to process or accept any order received from or through the Platform. 

(g) 賣方須作出合理的努力以滿足顧客透過本電子商務服務 提出的訂購，但倘若賣方基於任何理由（包括但不限於供應短缺、供應變化、未能就顧客地區安排送貨服務、或賣方對某商品收取了不正確的價格標示價格出錯）拒絕或未能滿足任何訂購，賣方無須向任何人士承擔責任。

   The seller shall make reasonable efforts to satisfy the orders placed by customers through this e-commerce service. However, if the seller fails for any reason (including but not limited to supply shortage, supply change, inability to arrange delivery services for the customer’s area, or the seller’s inability to The Seller shall not be liable to any person for goods charged an incorrect price (an incorrect price stated), refusal or failure to fulfill any order. 

(h) 在本電子商務服務上展示的商品及價格僅供參考，以下達相關訂單時的調整或修改為準。

   The products and prices displayed on this e-commerce service are for reference only and are subject to adjustments or modifications when placing the relevant order.

(i) 在本電子商務服務上展示的價格並不包括送貨費用。有關送貨費用的詳情，請參閲本電子商務服務上展示送貨費用。

   The prices displayed on this e-commerce service do not include delivery charges. For details about delivery charges, please see the delivery charges displayed on this e-commerce service.
